Processing actions and in vehicle data systems

Processing includes collecting, using, storing, sharing, analyzing, deleting, or changing personal data. A vehicle data collection system is any device in or on a car that collects, sends, or stores personal data about drivers or passengers. These actions and systems are covered by Utah privacy rules.

Who is covered and your privacy rights

A consumer is a state resident acting in a personal or household role, not a job or business role. A child means under age 13. Consent must be a clear, voluntary yes from you. Companies verify your identity when you use your privacy rights. The chapter’s “Account” refers to the Consumer Privacy Restricted Account, and “rights” means the privacy rights listed in the law.

Some terms match federal definitions

The law uses federal health privacy terms. It adopts the HIPAA meanings for covered entity, business associate, and protected health information. It also uses the federal definition of air carrier.

Which companies are responsible for data

A controller is a company doing business in Utah that decides why and how your data is used. A processor handles personal data for a controller. Affiliates include companies under common control or branding. Control includes owning over 50% voting power, picking most directors, or controlling management.

Rules for data sales and targeted ads

A sale means a company gets money for your personal data. Many transfers are not sales, such as sharing with processors, affiliates, or at your direction. Targeted ads are based on your activity across other companies’ sites or apps. Ads on one site, simple contextual ads, customer‑requested messages, and ad measurement do not count. These definitions set when opt‑outs for sales or targeted ads apply.

Sensitive and precise location data rules

Sensitive data includes race, religion, sexual orientation, citizenship or immigration, medical history, genetic or biometric IDs, and precise location. Specific geolocation covers GPS‑level data within 1,750 feet or 174 feet. It excludes message content and utility meter data. Biometric data includes fingerprints, voiceprints, retinas, or irises used to identify you, but excludes photos, audio or video, data from those recordings, and some health‑care uses.

What personal data is covered

Personal data means information linked to a person. The law excludes deidentified, aggregated, and publicly available information. It sets strict steps to keep data deidentified, and treats some computer‑made synthetic data as deidentified. It defines pseudonymous data as data kept separate from the keys that identify you. Businesses can keep trade secrets confidential.
