The Division of Air Quality may charge an annual compliance fee to permitted aggregate operations. For 20 tons or less of yearly emissions, the fee is up to $750. For over 20 to 79 tons, up to $1,500. For over 79 to 99 tons, up to $3,500. For 99 tons or more, up to $4,500. This authority runs July 1, 2027 through June 30, 2028, then continues under the state budget law starting July 1, 2028. The Air Quality Board may adopt rules. The law takes effect May 6, 2026.
A fugitive dust facility must post a sign at the entry that the public can see. This applies if the site is larger than 0.25 acre, makes fugitive dust, and the Division requires a dust control plan. Covered sites include aggregate operations, excavation sites, and topsoil or bulk material handling. Farms and road sanding or salting for snow and ice are excluded. The sign must show the site name, permit ID, business ID, and contact details for the manager or owner and the Division of Air Quality. This rule starts May 6, 2026.
The law reorganizes the state environmental agency into five divisions: Air Quality, Drinking Water, Environmental Response and Remediation, Waste Management and Radiation Control, and Water Quality. Each division runs the chapters of law for its area. Each division has a director appointed by the executive director, who can remove the director at will. A director must have needed administrative skills and a four-year degree in science, engineering, a related field, or law, and serves as the board’s executive secretary. The law also repeals a prior code section (19-2a-101). These changes take effect May 6, 2026.
