Stricter unemployment tax and misclassification fines

Starting May 6, 2026, the workforce division sets by rule the penalties for late unemployment reports and unpaid contributions. The division also sets the interest rate on unpaid amounts, replacing the fixed 1% per month. Employers who fail to file or file a wrong report because they misclassified a worker face a rulemade penalty. Penalty and interest amounts can change over time as rules change.

New disclosure rules for public subcontractors

Before starting work on a public project, subcontractors must give the contractor and owner a list of current employees, any planned second‑tier subcontractor’s name and license, estimated labor hours, and, if they hold a zero‑payroll workers’ comp policy, written notice and a copy. Workers on site must have photo ID available for division inspection. If the division asks, subs must give each employee’s name, last four of SSN, and any license number. Contractors and owners must keep these records for three years and provide them to the division on request. The division can share this information with the State Tax Commission. Not following these rules is unprofessional conduct for licensees. The law states that if H.B. 40 is also law, these subcontractor rules are placed in H.B. 40 starting January 1, 2027, and this section does not take effect. These duties otherwise take effect May 6, 2026.

Stricter rules for zero payroll comp policies

If you apply for a zero‑payroll workers’ comp policy, the insurer must get a signed, all‑caps attestation. You must state you have no employees and zero estimated exposure. If you later hire, you must tell the insurer in writing within 60 days and give estimated payroll and classification codes. Knowingly false or incomplete statements can be a crime. This rule starts May 6, 2026.
