New EMS license to carry controlled drugs

Beginning May 6, 2026, the state issues a controlled‑substance license to registered EMS agencies. A licensed agency and its EMS staff may carry, distribute, and give controlled drugs. They must follow the license and state and federal law. Care must follow a standing or verbal order from the medical director or another authorizing professional.

Rules, fees, and records for EMS drugs

Beginning May 6, 2026, the division sets rules for EMS controlled drugs and consults with the EMS bureau. Each registered EMS agency must get a license for every DEA‑listed location and have at least one registered location. A separate DEA certificate is not required for every station. The division charges reasonable fees to issue and renew licenses. Agencies must keep required records and inventories at a registered location and may not falsify records or refuse inspections. Licenses renew every two years. The division may adjust one renewal by up to one year to stagger dates.

Stronger penalties and suspensions for EMS

Beginning May 6, 2026, the division may fine a licensee up to $5,000 per violation. It can also deny, limit, suspend, or revoke a license for listed violations. The division may suspend a license immediately for an imminent danger. It may seal premises and seize drugs. After a final revocation, drugs may be forfeited. If an agency loses or surrenders its DEA registration, the division immediately suspends the EMS drug license. Reinstatement generally requires the DEA registration to be restored, unless other actions block it. Collected penalties go to a state account the division uses for the controlled‑substance database. Unpaid penalties can be collected through the state debt office, a collection agency, or a court case. Courts must award the division its attorney fees and costs when it wins.
