Beginning July 1, 2027, you can request a copy of your personal data from a covered social media service. The company must send it within five business days in a portable, easy-to-use format. The data includes your social graph: your posts, comments, reactions, mentions, shares, and related metadata. It does not include other people’s content or your private messages. You can use the file to send your data to another service that processes data automatically.
Beginning July 1, 2027, social media companies must offer a clear interface that lets you share your chosen data with other services. They must use an open, public protocol, keep sharing in real time on fair terms, and publish up-to-date guides and the protocol they use. You must see a simple, persistent way to give consent, and your choice must be applied within five business days. Companies must reasonably secure data shared through the interface. Companies may set reasonable request limits and charge a reasonable fee only beyond those limits. They cannot share or accept your data through the interface without your consent, including when others share a social graph.
Beginning July 1, 2027, companies are not required to share internal inferences, analyses, or proprietary algorithms. They also are not required to send data stored in a private format when no open standard exists and sharing would reveal protected internal information. The division may name approved open protocols; using one gives a rebuttable presumption that access terms are fair. A short outage is not a violation if the company acted in good faith and worked to restore sharing quickly. The law does not require a company to accept inbound data through the interface.
Beginning July 1, 2027, the rules cover public sites or apps that show user-made content, let people register, connect users, list other users, and let users post for others to see. The rules do not cover email, cloud storage, or document sharing and collaboration tools. They also do not apply to entities run by a religious organization that are exempt from property tax under state law.
