New air permit fees and caps

Beginning May 6, 2026, annual air emission fees apply to all Title V sources and regulated pollutants, on top of any approval‑order fee. Fees are based on actual emissions unless you elect allowable emissions before permit issuance or renewal. No fees apply above 4,000 tons per pollutant per source each year, and the same emissions cannot be counted twice. Any Title V fee requires a public hearing and legislative approval; fee money only funds the permit program and small business help. You may choose separate contracted services and pay a contracted‑service fee; the department cannot let that harm service to others. If you pay late, the department may add up to a 50% penalty plus 12% yearly interest.

Inland port air and water tracking

Beginning May 6, 2026, the department sets air and water quality baselines for the inland port area and air baselines for the airport. It installs research‑grade air monitors for particulate matter, ozone, and nitrogen oxides, and collects groundwater samples for sediment, metals, organics, and nutrients. The department posts the data online and gives a yearly report before November 30 to the Inland Port Authority board and lawmakers.

Faster environmental permits for businesses

Beginning May 6, 2026, the environmental department offers an expedited path for certain permits named in rule. You must request it in writing, submit a complete application to a qualified reviewer, and pay all expedited‑review costs. Reviewers must have an active license, 5+ years’ experience, no disqualifying convictions or recent license actions, and no work or financial ties to the applicant in the past 3 years. The department sets eligibility, standards, timelines, and public comment steps. The reviewer sends a written preliminary decision with analysis. The department does a final technical review, makes the final decision, and you may appeal under existing law.

Faster oil and mining permits

Beginning May 6, 2026, the oil, gas, and mining division offers expedited review for eligible permits named in board rules. You must request it in writing, submit a complete application to a qualified reviewer, and pay all expedited‑review costs. Reviewers need an active license, 5+ years’ relevant experience, no disqualifying convictions or recent license actions, and no work or financial ties to the applicant in the past 3 years. The division sets standards and timelines; reviewers submit a preliminary decision with analysis. The division makes the final decision and you may appeal under existing law. The mining program’s administrator must have the technical background needed to run the program well.

Agencies coordinate on environmental health

Beginning May 6, 2026, the environmental department must sign agreements with Health and Human Services to divide environmental health duties and avoid gaps. It must also sign agreements with each local health department to set roles, allow delegation on request, pass through allowed funds, and review the agreements every year. Any required training or certification under this title must follow the state training law.
