Rolling-machine operators owe cigarette tax

Beginning January 1, 2027, if you operate a cigarette rolling machine, you must pay the cigarette tax on the cigarettes you make. The tax rate is the same as for other cigarettes. The tax applies on the day each cigarette is produced.

Tobacco tax rates and rules updated

Beginning January 1, 2027, most tobacco products are taxed at 86% of the manufacturer’s sales price. Moist snuff is taxed at $1.83 per ounce; partial ounces are taxed proportionally. Little cigars are taxed the same as cigarettes. Freight to a Utah destination counts in the manufacturer’s sales price for tax. The law also updates product definitions and requires manufacturers to test moisture at packaging, keep proof for three years, and give a moisture certificate to buyers. Buyers who reasonably rely on the certificate are protected; the manufacturer is liable if it fails to comply.

Remote cigar and pipe sales rules

Beginning January 1, 2027, retailers may ship cigars or pipe tobacco to Utah only with a Part 9 license and bond. They must collect and send Utah sales tax if they meet the state’s economic nexus test, and file quarterly reports. They must also collect and send the new tobacco tax on these remote orders. An age‑check system is required, and someone 21 or older must sign for delivery. Remote sellers may sell only cigars or pipe tobacco remotely, and may not make in‑person sales that need another license unless they hold it.
