State board approves disability-hire contracts

The law creates a three‑member advisory board within the division to run purchases from programs that hire people with disabilities. Members are the division director or designee, the Utah State Office of Rehabilitation director or designee, and a governor‑appointed private‑sector member for a three‑year term. The board identifies goods and services, sets prices, keeps a preferred contract list, and may award or renew contracts without competitive bidding. The board may hire an administrator to find programs, check quality and delivery, recommend prices, review bids, and report data. Starting January 1, 2027, the board must send a yearly report by October 1. It lists contracts issued and active, each active contract’s maximum compensation, total revenue, jobs for people with disabilities, metrics, and recommendations. These authorities start May 6, 2026 and end July 1, 2036.

Who qualifies as a community rehab program

The law sets who can use this purchasing preference. A qualifying community rehabilitation program is a government agency or 501(c)(3) that mainly employs and trains people with disabilities. For each contract, at least 75% of the workers have severe disabilities, and the program follows U.S. Labor safety rules or is a state‑approved supported employment program. It must have its principal place of business in Utah and, if selling goods, make them in Utah; if selling services, most workers must live in Utah. These rules apply from May 6, 2026 to July 1, 2036.

State buying preference for disability-hiring programs

The law requires state buyers to use the board’s preferred contract list when a community rehabilitation program’s offer fits the need, can be delivered in reasonable time, and is reasonably price‑competitive. A program can send a bid at any time and must state it is claiming this preference. The mandatory buy rule stops for the rest of a fiscal year once total contracts with these programs reach $5 million. These rules take effect May 6, 2026 and end July 1, 2036.
