Stronger protections for ranchers' grazing rights

If you own or run a grazing allotment, the law protects your animal unit months (AUMs). Active AUMs must match the maximum sustainable number unless on‑the‑ground science shows a temporary cut. Suspended AUMs must be justified by science and returned when conditions improve, with preference for domestic grazing. Extra forage above what was allowed on January 1, 2005 can be shared with wildlife after review by a governor‑appointed, balanced livestock‑wildlife committee. Your allotment also counts as a valid existing right in federal withdrawal decisions if you meet state law requirements. Effective May 6, 2026.

State asserts control over lands and water

The state presumes legal control over subjects within Utah unless the U.S. Constitution clearly gives that power to the federal government. State agencies also presume federally controlled lands are under state police powers unless the federal government proves a constitutional basis or a past state cession of jurisdiction. Land plans should follow multiple‑use and sustained‑yield, not manage nonwilderness lands as wilderness outside the formal process. Decisions must prioritize school and institutional trust land purposes and protect access, roads, and local revenue. All waters of the state belong to the state and must be allocated through the state appropriation system, including any federal water requests. Effective May 6, 2026.

Mapping large landscapes and forest hazards

The law defines “landscape‑scale lands” as one or more connected tracts of at least 250,000 acres under common title, lease, or unified management in Utah. The state office must digitally map these lands by January 1, 2028 with layers for access, public nuisance areas, priority mineral lands, and high‑value mineral areas. The office coordinates with public and private partners and files an annual report by October 1 each year. The Division can identify landscape public nuisance areas on forested lands using factors like tree density, pests, fuel loads, slope, watershed water, weather, climate, and other relevant data. Section 63L‑11‑101 is repealed on May 6, 2026.
