New tax credits for big projects

Beginning May 6, 2026, very large infrastructure projects can get state tax credit certificates. Projects must meet big investment tests, like $50,000,000 in first or second class counties or $25,000,000 in others, or $10,000,000 for district thermal energy. Infrastructure construction must be at least 10% of total cost or $10,000,000. The Office of Energy Development issues certificates showing the credit amount a project can use to lower taxes.

Six-month freeze on special fuel tax

From July 1, 2026 to December 31, 2026, the special fuel tax rate stays at the January 1, 2026 level. The freeze ends January 1, 2027. This avoids a rate increase during that six‑month period.

Enterprise zone tax credits end 2026

The state’s enterprise zone tax credits end after December 31, 2026. Businesses cannot claim these credits for tax years after 2026.

New pipeline permit rules and deadlines

Beginning May 6, 2026, DEQ runs a new permit process for pipelines and other midstream facilities. Applicants must submit a project description, required environmental and safety studies, and proof they can finance the project. DEQ may charge a fee to review the application. The director must approve or deny a complete application within 120 days, with up to 30 extra days for extraordinary reasons or more time if both sides agree.

One-time boost for local roads

The law provides a one‑time $11,903,900 for B and C roads in FY2027. The money runs from July 1, 2026 to June 30, 2027 through the Transportation Pass‑Through program.

Radioactive waste expansion tax repealed

Starting July 1, 2026, the radioactive waste facility expansion tax is repealed. Entities that paid this tax no longer owe it after that date.

New tax on CNG, LNG, hydrogen

Starting January 1, 2026, CNG, LNG, and hydrogen used in motor vehicles are taxed at $0.212 per gallon equivalent. The commission adjusts the rate each year and posts new cents‑per‑gallon rates at least 60 days before they start. Adjusted LNG and hydrogen rates cannot go above $0.225 per gallon equivalent.
