3 provisions identified: 2 benefits, 0 costs, 1 mixed.
When a child enters Division custody, the Division checks for an existing therapist and contacts them. The Division helps the therapist enroll in Medicaid or contracts with them at a rate no higher than the Medicaid rate while the child is in custody. When the child leaves custody, the Division shares the therapist’s contact with parents, if the therapist agrees. The Division also coordinates ongoing care through Medicaid, if the family is eligible, and with the local mental health authority when needed. Starts May 6, 2026.
You can ask your child's insurer for a single-case agreement to keep an out-of-network therapist. It applies if your child left Division custody within 90 days and the therapist agrees. The insurer pays at its in-network rate, and you pay the usual in-network copays, coinsurance, and deductible; the agreement states its length and scope. Ask before the visit and show proof the child saw this therapist in custody and when the child left custody. It applies to traditional outpatient therapy, not residential or day treatment, and it does not add services your plan does not cover. Starts May 6, 2026.
All these requirements start May 6, 2026.
