Criminal and civil fines for negligence

Beginning May 6, 2026, criminally negligent violations of drinking water rules are a class B misdemeanor. Courts may impose up to $5,000 per day in criminal fines for each day of violation. Separately, courts may also impose up to $5,000 per day in civil penalties. These penalties apply only when criminal negligence is proven.

Daily fines and clear penalty notices

Beginning May 6, 2026, the law sets per‑day administrative fines for drinking water rule or permit violations. Systems serving fewer than 10,000 people face up to $1,000 per day per violation; systems serving 10,000 or more pay $1,000 per day per violation. Each day counts as a separate violation. The director can assess, collect, and settle these penalties, and must send a notice listing the facts, the law or rule broken, each penalty amount and start date, and a warning about civil collection. Penalties go to the General Fund, but the department may repay itself and local governments for extraordinary enforcement costs, defined by rule.

Stronger water system oversight and court fixes

Beginning May 6, 2026, the director can order suppliers to stop unsafe sources, issue boil‑water notices, and require fixes. Staff and agents may enter systems at reasonable times, with notice and ID, to inspect, sample, and review records. The director can sue for court orders; if filed in district court, the case is in the county of the violation. A court may appoint a receiver when a serious public health risk exists and the supplier will not or cannot correct it. A court may also order divestiture if needed for long‑term compliance, and the director must report the status of such cases to the proper legislative committee chairs.
