Fixes and refunds for wrong provider listings

Beginning January 1, 2027, when a directory error is reported, insurers must verify or fix it within 20 business days. Providers must answer accuracy checks within 15 business days. Insurers must audit each directory at least yearly, keep records, and correct errors. If you reasonably relied on wrong listings, the commissioner can require coverage and repayments, or in-network payment to the provider. Insurers must share accuracy data when asked, repeated nonresponse triggers educational letters, and covered entities must follow federal No Surprises Act rules.

Easier provider directories from your insurer

Beginning January 1, 2027, insurers must publish a provider list for each plan and update it at least every 60 days. The list must be easy to find online, with no login, and be searchable and downloadable. It must explain how the network is built and list key details like specialty, contact, accepting new patients, telehealth, and locations, plus how to report errors. A provider counts as accepting new patients if a supervised exempt clinician can see new patients. You can ask for a printed directory with the website, phone number, print date, and a check-online notice.

Timely mental health care out of network

Beginning January 1, 2027, if no in-network mental health care is available in time, your insurer must help. Timely means 15 days for routine care and 24 hours for urgent, emergency, or crisis care. The insurer must set up a single-case agreement so you can see an out-of-network provider. The provider cannot balance bill you; you only owe normal copays, coinsurance, or deductibles. Agreements only cover services your plan covers and within the provider’s license; experimental mental health care is excluded unless parity requires it. Insurers must keep payment records, and the insurance commissioner can set rules and enforce.
