Which data centers are covered

The law defines a “large data center” as one that uses 75 acre-feet of water a year or more and has at least 10,000 square feet of buildings. A “new” large data center is one that begins operations on or after July 1, 2026. These centers in Utah must follow the new notice, reporting, and disclosure rules.

Safe harbor for home rain capture

You can capture or store rain on land you own or lease without state enforcement for unauthorized diversion. You must follow local laws, not interfere with existing water rights, and design the system to slow or hold stormwater or protect watersheds. The water must be meant to soak in or be released, not used for other purposes.

Early water checks for new data centers

Before a city or county approves a land-use application for a new large data center, it must notify the Division of Water Rights, the Division of Water Quality, and the local water provider. For construction starting on or after July 1, 2026, the operator must, 90 to 360 days before construction, notify the water provider and report to the Division of Water Rights. The report must list the city or county, estimated annual withdrawals, any discharge treatment, any discharge temperature changes, and plans for reuse or replacement.

Tougher water law enforcement and deadlines

If a required report is missing or incomplete, the Division of Water Rights notifies the operator and may fine up to $100 per day until it is complete. The state engineer can start enforcement if a person fails to file required water reports and can sue in court to enforce a final order. Initial orders are not governed by the Utah Administrative Procedures Act, but rules must provide enforcement steps, a hearing on request, and timely final orders. No third party may intervene in these enforcement actions. A petition to review a final order must be filed within 20 days from when the order is served.

Data centers: annual reports and public data

Beginning July 1, 2026, each new large data center must file an annual report to the Division of Water Rights by July 1 for the prior year. The report must describe water‑saving steps, actual withdrawals, and actions to prevent polluted water. The Division must post each facility’s annual withdrawal data by September 1 and also post anonymized county trends. The Division must share non‑proprietary report data with the Division of Water Quality and the local water provider. Some specific items can be kept confidential as protected records if the operator follows the state process.
