Debtor ID needed for judgment liens

Beginning July 1, 2026, filings for judgments in the registry on or after September 1, 1998, and recordings after July 1, 2002, must include debtor ID. For individual debtors, this includes, if known, the last four of the Social Security number, birth month and year, and driver license number. Creditors must provide the information from their records or state that it is unknown or unavailable. A judgment is not a lien until a separate information statement with the required details is recorded. That statement must also list the parties and the recorder’s entry number, book, and page.

Stricter steps for judgment property liens

Beginning July 1, 2026, a judgment does not create a lien on real property unless it is filed in the district court’s Registry of Judgments in the county where the property is. For judgments entered on or after July 1, 2002, the judgment or an abstract must also be recorded with the county recorder. The Registry is the public index searchable by the debtor’s name. State agencies do not need to do the county recording step. The law also treats civil restitution and civil accounts receivable as judgments, and keeps a special entry‑date priority rule for judgments recorded between September 1, 1998 and June 30, 2002.

Wrongful liens and clear lien releases

Beginning July 1, 2026, any judgment or notice wrongfully filed against real property is covered by the Wrongful Lien Act. To release, assign, renew, or extend a judgment lien, you must record a document in every county where the lien was recorded. The document must show the action date, the parties, and the original recording date and entry number, book, and page.
