Beginning May 6, 2026, you can be offered the unused part of certain eye drops or ointments at discharge if you still need them. These include topical antibiotic, anti-inflammatory, dilation, or glaucoma medicines used in an operating room, emergency department, or ambulatory surgery center. They count only if pulled from a dispensing system during the visit, or ordered at least 24 hours ahead for your procedure. Any container you take home must have a Pharmacy Practice Act–compliant label. If the medicine was used in an operating room or ER, the facility must counsel you on how to use it. The usual pharmacist counseling rule does not apply when the facility gives these medicines under this section.
Beginning May 6, 2026, this part of the code uses the definition of "controlled substance" from Title 58, Chapter 37c. If both this act and H.B. 301 (Drug Recodification) are law, this act’s change to Subsection 26B-4-501(2) controls on May 6, 2026. These are technical rules that guide how agencies and facilities read and apply the law.
