Starting July 1, 2025, Utah state agencies must post any federal guidance letter they get on their website and on the Utah Public Notice Website. They must also send an electronic report to the Federalism Commission within 15 days with a copy or link, the letter’s purpose, any fiscal or administrative impacts, and any federalism concerns. For education entities, these duties start May 6, 2026. If a federal agency rescinds a letter, the state agency must post the rescission and a clear notice and send it to the commission within 15 days. Agencies must keep these pages permanent, easy to use, and linked from the agency’s main page. Agencies may also post older letters received before those start dates. The law defines which letters and which education bodies are covered.
From May 6, 2026 through July 1, 2028, the Federalism Commission expands its tools and reporting. It may contract with a Utah college to monitor federal laws and report issues. It may ask Utah’s U.S. senators or representatives for information. If it finds federalism problems, it may send written notice to federal agencies, ask for a reply by a set date, and request meetings. It may recommend that the governor call a special legislative session. The commission must keep a public list of evaluations, actions, state coordination, and any federal responses on the Legislature’s website. It must report each year to the right interim committees, and also file a report by November 30 to the Government Operations and the Natural Resources, Agriculture, and Environment interim committees with actions and any proposed bills. When discussing environmental issues, it must follow the state’s environmental discussion process.
From May 6, 2026 to July 1, 2028, the commission runs a public federalism seminar program and posts a curriculum on topics like the Tenth Amendment and state sovereignty. It may apply for grants and accept private donations to fund this work. The commission coordinates with the state’s federalism center and institute, makes recommendations, and reports each year to the Legislative Management Committee on their progress, including federal guidance letters. When asked, each state executive agency names a contact to help with education and to review federal actions and possible responses. The attorney general registers and protects the “National Federalism Commission” and “National Federalism Initiative” trademarks, and the commission may license or transfer them to listed Utah institutions.
Most parts of this law take effect May 6, 2026, unless a section lists a different start date. The statute that governs the Federalism Commission is repealed on July 1, 2028.
