Cities and counties may adopt and enforce short‑term rental rules. They may also regulate people who take part in marketplace transactions, such as home hosts or small sellers. These local rules can create duties or costs for hosts and sellers. Beginning May 6, 2026, these powers remain in force.
Local police and prosecutors still enforce state criminal laws tied to marketplace activity. Cities and counties can also sue to protect their own intellectual property. These enforcement powers apply beginning May 6, 2026.
The law takes effect on May 6, 2026. From that date, the new marketplace rules apply in Utah.
The law stops cities and counties from regulating how online marketplaces operate. Local governments cannot force a platform to hand over users’ personal data without an administrative subpoena or a court order. Cities and counties may still ask for help from platforms, but it is voluntary. The law defines what counts as an online marketplace and what “personal data” means. Beginning May 6, 2026, these rules apply statewide.
