Beginning May 6, 2026, employers cannot require confidentiality clauses that hide sexual harassment or assault. Employers may not retaliate when an employee reports misconduct or refuses to sign such a clause. If an employer tries to enforce a forbidden clause, the employer owes all legal costs and cannot collect damages. An employee who agrees to a settlement with a confidentiality clause about sexual misconduct has three business days to withdraw.
Non-competes signed on or after May 10, 2016 cannot last more than one year after employment ends. Broadcasting non-competes are valid only for exempt employees, must be in a reasonable written contract, and apply only if the employer fired for cause or the employee breached; they cannot exceed one year or the contract term. The law still allows non-competes in a severance deal that is mutually and freely agreed in good faith at or after termination, and in a business sale when the person gets sale value. If a judge or arbitrator finds a covenant unenforceable, the employer must pay the worker’s arbitration fees, court costs, attorney fees, and actual damages.
Beginning May 6, 2026, veterinarians cannot be bound by non-compete agreements. Any nonsolicitation agreement, or an NDA that stops a vet from talking about their work experience, is void. These bans do not apply when the veterinarian owns at least 5% of the business. Contracts also cannot force veterinarian disputes to be heard outside Utah.
The law repeals Section 34-51-101 of the Utah Code on May 6, 2026. This is a code cleanup; direct effects depend on what that section used to do.
