Stronger fairness and privacy for private probation

Beginning May 6, 2026, private probation providers must be neutral and explain their role and process. They must keep information confidential when the law protects it and tell you when it does not. They must disclose any conflict of interest and step aside if one exists. They must follow standards set by the licensing board.

You choose your treatment program

After your risk and needs screening, the probation provider must give you a list of all programs that offer any required assessment or treatment. You choose which program to use. This applies beginning May 6, 2026.

Tighter rules on probation conflicts and solicitation

Beginning May 6, 2026, private probation firms cannot solicit clients on court property. A human services program cannot supervise you and sell you other paid services at the same time. There is a narrow exception only when no other program is within 50 miles of your home and you sign written informed consent. The consent must say what extra services are proposed, how to withdraw consent, how to file a complaint with the investigation office, and that a conflict may exist. The division revokes a provider’s license if the provider breaks this ban. The law also uses the standard definition of “human services program” for these rules.

Private probation: contracts, fees, and reports

Beginning May 6, 2026, a private probation provider may work in a county that has its own probation services only if the provider has a contract with the local agency. That contract must list the fees the provider will charge defendants. Providers must tell the court when they supervise a defendant and follow court orders under Section 77-18-105. Providers must also send each county sheriff a monthly report listing each person they supervise, the crimes, the supervision level, and any other sheriff‑requested details, following HIPAA privacy rules.
