Beginning May 6, 2026, businesses can apply to reuse industrial byproducts in public projects. The director decides within 60 days after the application is complete. Approval requires the byproduct to meet the commercial or industrial health risk standard, pass the TCLP test, and use an installation method that meets that standard. Once approved, the byproduct, used in place of a raw material, can be used in any project such as roads, curbs, walkways, parking, transit facilities, and other public works. Approved reuse is exempt from human health or ecological risk assessments or site management plans, and from environmental covenants.
Beginning May 6, 2026, some materials do not count as industrial byproducts. Materials that cause a public nuisance or a public health hazard are excluded. Materials that are hazardous waste under Part 1 are excluded. Coal mine waste, as defined in 30 C.F.R. 701, is excluded. These materials cannot use the reuse approval path.
