Beginning May 6, 2026, a constable can set up a payment plan instead of taking your property. This applies only if the party directing the seizure agrees. The plan replaces a seizure when that party approves.
Beginning May 6, 2026, county‑appointed constables serve six‑year terms and may be reappointed. For constables appointed on or after July 1, 2018, the term ends six years from the day it began.
Beginning May 6, 2026, a constable may act only for the government that contracts with them, the county that appointed them, or the court that directs them. They may not serve as an agent for private persons.
Beginning May 6, 2026, an appointed constable may, with county approval, deputize people who are certified as special function peace officers. If the county withdraws a constable’s authority, all of that constable’s deputies also lose authority. The county must notify the POST Division when authority is withdrawn.
Beginning May 6, 2026, constables may serve any legal process anywhere in Utah. Before serving a writ of execution or seizing property outside their appointing county, they must contact the local sheriff or police. Before serving an arrest warrant, an appointed constable or deputy must notify that jurisdiction’s sheriff or police. A constable must attend justice courts in their county when a contract or court order requires it. They must execute, serve, and return all process delivered by a justice court judge or other competent authority.
