State push to develop geothermal power

Beginning May 6, 2026, the state promotes finding and using geothermal resources for electricity. It authorizes cooperative production, injection, and pressure maintenance to get the most resource recovery. The law also aims to prevent waste, protect each owner’s fair share, and safeguard the environment and public welfare.

Trust can lease and partner on geothermal

Beginning May 6, 2026, the trust may lease geothermal, coal, and mineral resources on a rent-and-royalty basis. With board approval, it may enter joint ventures, farmouts, exploration, operating, and other business deals. These special agreements are not subject to some usual statutory limits that apply to other disposals. The mineral estate still cannot be sold unless another law allows it.

State keeps geothermal under trust lands

Beginning May 6, 2026, the state reserves all geothermal resources under school and institutional trust lands. Certificates of sale and land patents must show this reservation. Buyers of these lands get no right or title to the geothermal resource. The state and its partners may enter and use as much surface as is reasonably needed to explore or develop those resources.
