Manufacturers must file annual patient reports

Beginning May 6, 2026, a manufacturer that gives an investigational drug or device to a Utah patient must file a report. Send it to the Health and Human Services Interim Committee before November 1 after the product was provided. The report lists how many patients got the product, which illnesses were treated, and likely adverse outcomes. Reports are not required if the patient was in an FDA clinical investigation.

New rules for patients using trial treatments

Beginning May 6, 2026, the law updates who can use investigational drugs or devices in Utah. Cancer counts as a terminal illness when a board-certified oncologist says so. A patient must have a life-threatening or severely debilitating condition and, after exploring standard treatments, no option that is satisfactory or comparable. A Utah-licensed physician must diagnose the terminal or eligible illness. The product must have finished FDA Phase 1 testing and be in an FDA-compliant clinical study.
