Stronger shield from punitive damages for employers

For claims arising on or after May 6, 2026, employers, principals, and managing agents are not vicariously liable for punitive damages just because of the job relationship. To get punitive damages from the employer based only on a worker’s conduct, the plaintiff must prove by clear and convincing evidence willful, malicious, or reckless conduct; that the employer authorized, ratified, or approved it; or that the employer was reckless in hiring or keeping the worker. This also applies to cases from operating a vehicle or motorboat while voluntarily intoxicated or under the influence of alcohol or drugs. A “managing agent” means someone who supervises a facility, operation, project, or group, or acts as a manager.

Insurers can't cover or price punitive damages

Beginning May 6, 2026, insurers in Utah cannot insure punitive damages. They also cannot consider the chance of punitive damages when underwriting, rating, or setting premiums or fees. If a court awards punitive damages, you or your business must pay them yourself. Removing this pricing factor may slightly raise or lower some policy prices.
