Stronger control over your identity online

Beginning May 6, 2026, you control consent to use your name, image, voice, and AI‑made likeness. You can license this right, but you cannot sell it while alive. It lasts your life and 70 years after death, and your estate can transfer it. It applies retroactively to people who died within 70 years before May 6, 2026. Abuse includes using your identity for ads, fundraising, solicitations, or sales without consent; publishing a likeness knowing it was unauthorized; or selling tools mainly meant to make unauthorized identity content. These rules cover minors and up to 70 years after death. You or a right holder can sue to remove content and get damages, exemplary damages, and attorney fees. You can also sue a publisher when the content clearly looks nonconsensual and the publisher failed reasonable steps to confirm consent. People who commission or submit such content can be treated as causing the publication. Exemptions protect news, public affairs, sports, documentaries and historical or biographical works (unless they falsely imply real participation), political or public‑interest works, parody or satire, incidental uses, and ads for those works. Using a commercial platform alone is not advertising. Online platforms are not liable for others’ posts under this chapter.

New rules for AI-based defamation

Beginning May 6, 2026, defamation claims for digitally created content follow new steps. You must send written notice that identifies the content, where it appears, and why it is false, by certified mail or an electronic method with proof, before suing. If the publisher removes it within 10 days after receiving the notice, you can recover only actual damages. It is not a defense that AI or other tech made the content or that it is simulated. The law defines generative AI as a system trained on data, responding to human input, and able to make human‑like content.
