New registration and staffing rules for applicator businesses

Pesticide applicator businesses must register and pay a department-set fee. The department issues a certificate if you show competence and good character, owe no money, and apply. It removes old owner education and experience rules. Certificates expire December 31 of the second year; violations can trigger suspension until you fix them. You must employ at least one certified applicator, only hire licensed applicators, permitted techs, or permitted salespersons, and ensure workers follow labels and rules. The department can create a lighter registration for marketing-only firms, and fee money only funds this program.

Permits, training, and fines for techs and sales

The law defines ornamental and turf technicians and pesticide salespersons as people who hold permits. The department sets training and supervision rules for technicians and defines what counts as soliciting, plus training rules for salespersons. Violations tied to ornamental and turf technician rules can bring fines up to $1,000 per violation. The department must report on these rules by the November 2026 interim meeting.

Stronger product enforcement and labeling rules

The department can order a pesticide lot to stop sale, use, or movement if offered in violation of the law. Before a written release, the owner or distributor may have to pay the department’s costs to withdraw the product. Courts cannot require the department to post a bond when it seeks an injunction. The law aligns label “signal words” with federal terms like danger, warning, or caution, and clarifies which species and herbicide uses fall under the chapter.

Applicator reciprocity, misuse defense, return fines

The department can waive Utah exams for certified applicators who hold substantially similar licenses from other states. If you are accused of misuse, you can defend yourself by proving you followed the label and rules at the time. If your certified applicator license is revoked or suspended, you must return it within 14 days or face up to $100 for each 14-day period it is late.
