Central court processing for evictions and debt

Beginning Jan 1, 2027, the Judicial Council can create district court divisions, including one for debt and housing cases. Courts must move qualifying eviction and debt cases to that division for pretrial and post‑judgment steps. A “debt collection or housing action” includes eviction cases and cases that can be filed as debt collection on or after Jan 1, 2027. The division can send a case to the proper venue for trial or for evidentiary hearings that are not eviction hearings. Creating divisions does not change court jurisdiction, undo existing orders, or reduce public access. If a division is created, the Council must staff it with commissioners or judicial assistants using legislative funds.

Faster, clearer process to fill judge seats

The law sets firm steps to fill judge seats. Commissions choose top applicants by majority vote and can investigate and consult with the Judicial Council. They must certify a list within 45 days and send it to the governor, the Senate president, the Senate minority leader, and legislative counsel. List sizes are set: seven names per appellate vacancy, five per district or juvenile vacancy, and seven per Business and Chancery vacancy; when there are multiple openings, add one extra name per extra vacancy, or five extra for appellate openings. Commissions must confirm each nominee is qualified and willing, cannot block a name for past commission decisions, and cannot certify a judge not retained until the term ends or someone who served on a commission within six months. The governor must appoint within 30 days; if not, the Chief Justice picks from the list within 20 days. Commissions are exempt from the Open and Public Meetings Act, so some meetings are closed.
