Small businesses get defense in website suits

Starting May 6, 2026, Utah lets a defending party sue over abusive website‑access lawsuits. The Attorney General can also file for the defending party. A case is presumed abusive if the business got detailed written notice and either tried in good faith to fix it within 30 days or fully cured it within 90 days. A court cannot decide abusiveness until those windows end or the site is cured. If abusive, the court may grant the defending party reasonable attorney fees and costs, and may add punitive damages or sanctions, capped at three times the fees. The law defines key terms so parties know who is covered. These rules end July 1, 2031.

Parental representation pilot ends in 2026

The Interdisciplinary Parental Representation Pilot Program ends December 31, 2026. Parents and guardians who used the pilot lose that representation option after that date.

Domestic violence case transfer rule ends

On July 1, 2029, Utah repeals the rule that moved some domestic violence criminal cases from justice court to district court. Without that rule, which court hears a case can change. Judges and people in these cases may see a different court handle the case.

Employer liability shield repealed in 2029

On July 1, 2029, Utah repeals the statute that limited employer liability when an employee was convicted of an offense. Employers lose that shield. People harmed in these cases may see different remedies in court.

State mediation and arbitration rules end

Utah repeals the Alternative Dispute Resolution Act on July 1, 2026. It also repeals the state section on arbitration agreements on July 1, 2029. People and businesses that used those statutes no longer have those state rules and must rely on other procedures or law.

Website-access rules end July 2031

On July 1, 2031, Utah repeals the special rules for website‑access lawsuits. After that date, those definitions, presumptions, and remedies are no longer available under that Part.
