Execution participation or refusal protected

Beginning May 6, 2026, a doctor is not guilty of unprofessional conduct for refusing to take part in an execution. Helping with an execution is also not misconduct if it follows state law and Department of Corrections protocol. This protects both conscience and lawful participation from discipline.

Protections for medical cannabis and trials

Beginning May 6, 2026, doctors are not disciplined for recommending medical cannabis or providing pharmacy medical services if they follow Utah’s medical cannabis law. Doctors may also get or give investigational drugs or devices to eligible patients, as long as they follow Section 58-85-103. The Division must write rules that define unprofessional conduct for physicians working within the medical cannabis program. These steps give providers and patients clearer, safer access within the law.

Stronger conduct rules for doctors

Beginning May 6, 2026, Utah tightens what counts as unprofessional conduct for physicians and osteopathic physicians. Using unqualified or improperly supervised helpers, lying about licensure qualifications, or breaking state medicine‑dispensing rules are misconduct. Violating the medical cannabis statute, performing illegal abortions, or falsifying records to hide wrongdoing are also misconduct. Doctors cannot perform sex‑characteristic surgeries on anyone under 18, and they cannot place a child on a DNR order without a parent’s consent. These rules let the state discipline licensees to protect patients.
