Paid caregiver leave for government and some private workers

The law gives paid administrative caregiver leave each month. Full-time Government of the Virgin Islands employees get 4 hours per month. This includes workers at boards, commissions, agencies, autonomous and semi‑autonomous agencies, and instrumentalities. Full-time employees of beneficiaries under the Industrial Development Program or employers with benefits under Act No. 4740 get 2 hours per month. You must be the primary caregiver for a seriously ill spouse, child, parent, or legal dependent, or have taken on care of an older or dependent adult under Virgin Islands law. The leave is for caregiving duties and is available each calendar year.

48-hour proof rule for paid caregiver leave

If you take caregiver leave, you must give proof to your employer within 48 hours after the absence. The proof must show the time off met the law’s caregiving rules. If you do not provide proof on time, your employer may refuse to pay you for those hours.
