Education employers—school boards, charter school boards, and private schools in state choice or special needs programs—cannot make deals that hide, destroy, or block reports about alleged immoral conduct by an employee. They also cannot require records to be erased, unless an investigation finds the claim false or not proven. When a prospective employer asks, a school may share information about a current or former employee’s conduct, including immoral conduct. The school is immune from civil lawsuits for giving that information. This immunity adds to other protections in state law.
