Capped improvement security and permit release
Local governments cannot require public improvements to be installed or accepted before you can submit, review, approve, or record a plat. They may still require you to install improvements and post financial security to ensure you finish them after approval. That security at the start cannot be more than 120% of the estimated total cost to complete the improvements. When the required improvements are substantially complete, any local building permits tied to that work must be released.
Faster plat reviews for developers
Before you file, the city, town, or county must offer an informal concept meeting. Opinions from that meeting are not binding. When you file a preliminary plat, the authority must approve, approve with conditions, or reject it in writing within 90 days. You can agree to more time, but if they do not act in time, it counts as approved. You may submit preliminary utility and road plans with the preliminary plat, and they cannot reject only because those plans are not final. They can approve with conditions to finish the plans later. After your final plat is approved or deemed approved, the clerk must place the recording certificate within 10 days of your request.
When the new plat rules start
The law takes effect on the first day of the seventh month after publication. Plats submitted on that effective date follow the new approval and improvement rules.
