Clear pay rules for real estate agents
Agents cannot take fees from someone other than their client or firm unless everyone in the deal gives written consent. Firms may not pay or accept compensation from another firm in a 1 to 4 unit home deal, except allowed referral or finder fees; any deal that breaks this is void. If a seller will pay a non‑listing firm, that promise must be in the fully executed offer or option and signed by both buyer and seller, or no payment. A listing contract cannot require or imply that the seller will pay another firm unless that pay also appears in the signed offer. Listing contracts must state whether the seller lets the listing firm disclose any offer of pay to other firms. Agents must give written notice when they recommend a service that may pay them or that they own. All rules start January 1, 2027.
Faster marketing and owner choices for homes
For homes with 1 to 4 units, the listing firm must share info with buyer agents, answer questions, allow showings, and post the listing online within one business day of the agency start. An owner can opt out of public marketing by signing the state form. The board publishes a brochure that explains the pros and cons of opting out. Owners may allow e-signatures and may name people they will not work with, while following fair housing laws. Agents are protected from civil liability for good‑faith disclosures made to meet these duties. These rules start January 1, 2027.
Truth in ads for edited photos
If an agent changes a property photo or ad using technology, including AI, in a way that misleads, the ad must say it was altered. This applies to licensee advertising. Starts January 1, 2027.
