After a final commitment order, you keep the right to informed consent unless a court finds you not competent or in an emergency. Any motion to medicate must include a report with a doctor-signed statement that you need the treatment and are not competent to refuse it. That statement can be based on an exam by a doctor or by an advanced practice registered nurse with psychiatric training. Until September 1, 2026, an advanced practice registered nurse defined in state law with psychiatric training may do the exam. Starting September 1, 2026, the nurse must also have prescriptive authority under s. 441.09(2). The court usually holds a hearing within 10 days of the motion, or within 20 days if postponed. Emergency medication can still be given to prevent serious harm.
