Utility fuel costs now count capacity

The law updates fuel cost rules for electric utilities with an approved fuel cost plan. The Public Service Commission must defer any fuel under-collection or over-collection that is outside the utility’s yearly tolerance for later recovery or refund. Fuel costs now include the cost to buy and the revenue from selling generation capacity. The capacity must meet the Midcontinent Independent System Operator’s capacity rules. Customer bills can go up or down later based on these deferrals and capacity transactions.
