The law makes it illegal to make a copy of a private intimate image or video when the person pictured did not consent. A private representation is sexual content meant to be seen only by the people it was shared with. Making such a copy without consent is a Class A misdemeanor.
The law makes it a Class I felony to post, publish, share, or show a synthetic intimate image of an identifiable person to coerce, harass, or intimidate them. It defines a “synthetic intimate representation” as an image made with technology that uses a real person’s face, likeness, or other trait to show nudity or sexual content. This covers deepfakes even when parts of the image are computer-generated or taken from public sources.
