The Secretary must create a special selection review board when a person a promotion board picked for promotion (to a grade at or below rear admiral) is found to have credible bad information about them that the promotion board did not have. While the special board reviews that person, the person’s name must not be put on the public list of recommended promotions or sent to the President or the Senate. The special board must follow the same rules as a regular promotion board and can review as many people as the Secretary directs. The board gets the record the original promotion board had and any new adverse information, including confirmed findings from an official investigation under section 2115(a)(3). The person must be given that information and a chance to comment before the board meets, unless the information is classified (then a summary will be given if possible). If the person already saw and commented on the information for the original promotion board, those comments go to the special board. The board compares the person’s record, without naming them, to samples of officers who were recommended and not recommended. The board should use the same standards the promotion board used. A promotion recommendation is kept only if a majority of the special board agrees that the person ranks higher than the highest non-selected sample and is comparable to those who were selected. If the special board keeps the recommendation and the President approves, the person is promoted as soon as practicable with the same rank date, pay date, and position on the active list as originally recommended. The Secretary must make rules to run this process. promotion board — the regular selection board that recommends promotions under section 2106.
