The Board can take gifts, bequests, or other property for the John F. Kennedy Center, hold and manage them, and sell or invest what it gets unless the donor says otherwise. Income from those funds must be kept where the Board decides and can be spent by the Board. The Board must appoint a Chairperson as the Center’s chief executive and a Secretary, and it sets their pay and duties. The Chairperson may hire a senior executive to run facilities and other needed staff. The senior executive may be paid from appropriated funds even if normal federal hiring rules would not allow it, but the pay cannot be more than the maximum rate for Level IV of the Executive Schedule under section 5315 of title 5. By October 1, 1995, property, contracts, records, and unspent funds tied to functions moved from the Secretary of the Interior were to be transferred to the Board and used only for their original purposes. National Park Service employees doing those jobs were to transfer to the Board by that date, stay in the federal competitive service with title 5 rights, and have priority consideration for Interior vacancies for at least 3 years. Park Police assigned to the Center stay employees of the National Park Service. The Board may reorganize, and the Board’s decisions about performing arts and payments from trust funds can only be reviewed by a court. Nonappropriated fund “theatrical employees” covered by a collective bargaining agreement as of January 1, 1994 are treated as employees under the National Labor Relations Act and related law, and the Board is treated as their employer. The Board may also plan projects to improve pedestrian and vehicle access with approval of the Secretary of the Interior under section 76j(a)(2)(F).
