The American Battle Monuments Commission may collect donations and other money to pay for the World War II memorial. The World War II memorial means the memorial authorized by Public Law 103–32 (40 U.S.C. 8903 note) to be built on Federal land in the District of Columbia or nearby to honor those who served in World War II. A special Treasury fund is set up for the memorial. That fund holds donations, interest and sale proceeds, certain coin surcharges, money the Commission borrows, and income from licensing marks or copyrights under section 2114. The Commission’s chair must put donations into the fund. Money not needed for current expenses can be invested in U.S. government obligations chosen by the chair. The fund may be used for building the memorial, the maintenance and preservation amount in section 8906(b) of title 40, other non-routine memorial costs, and for securing or licensing marks and copyrights tied to the memorial. To finish the memorial on time, the Commission may borrow up to $65,000,000 from the Treasury. Interest rates and loan terms are set by the Secretary of the Treasury, loans may run up to 20 years, and deferred interest also accrues interest. The Treasury will buy the Commission’s obligations, and any loan payments must come from the memorial fund only. The Secretary of the Interior must count the Commission’s borrowing authority as available money to complete construction under section 8906 of title 40. The Commission may accept volunteers for fundraising and may pay their small expenses; volunteers get injury and tort protection but are not federal employees for other purposes unless they handle funds or federal duties, in which case certain conflict-of-interest and conduct rules apply. Design or construction contracts are not “funding agreements” under section 201 of title 35. The authority to build the memorial under Public Law 103–32 ends on December 31, 2005.
