Title 38 › Part PART II— - GENERAL BENEFITS › Chapter CHAPTER 18— - BENEFITS FOR CHILDREN OF VIETNAM VETERANS AND CERTAIN OTHER VETERANS › Subchapter SUBCHAPTER IV— - GENERAL PROVISIONS › § 1831
Defines who counts as a "child" and who is covered for benefits. For subchapters I and II, a "child" is a veteran’s natural child (age or marital status does not matter) if the child was conceived after the veteran first entered the Republic of Vietnam during the Vietnam era. For section 1821 (Korea) and section 1822 (Thailand), a "child" is a veteran’s natural child conceived after the veteran first entered the service period described in subsection (c) of that section. A "covered child" is a child eligible for health care and benefits. A "covered veteran" is someone whose children are eligible. A "Vietnam veteran" is anyone who served in Vietnam during the Vietnam era, no matter how their service was characterized. The "Vietnam era" runs January 9, 1962 to May 7, 1975 for subchapter I, and February 28, 1961 to May 7, 1975 for subchapter II.
