The Secretary can waive parts of the program rules in an emergency area and during an emergency period to help protect the health and safety of people getting care and the public. The Secretary may not spend more than 5 percent of the funds allocated under this subchapter for sections 300ff–29a and 300ff–13(b). Emergency area: a place with a President-declared emergency or disaster under the National Emergencies Act or the Robert T. Stafford Disaster Relief and Emergency Assistance Act, or with a public health emergency the Secretary declares under section 247d. Emergency period: the time when one of those declarations is in effect. If grant funds are not spent in the fiscal year the emergency is declared, they must be returned to the Secretary for reallocation under sections 300ff–13(b) and 300ff–29a.
