Title 45 › Chapter CHAPTER 19— - ROCK ISLAND RAILROAD EMPLOYEE ASSISTANCE › § 1007
If an employee gets help under an employee protection agreement or benefit schedule made under section 1005, or new career training help under section 1014, the employee gives up any other employee protection benefits they might get under the Bankruptcy Act, subtitle IV of title 49, or under any contract or agreement — except for the Labor Protective Agreement signed in Washington, D.C., on March 4, 1980. Any Rock Island Railroad employee entitled to help under this chapter must, within 120 days after the effective date of an agreement under section 1005(a) or a benefit schedule under section 1005(b), file a statement with the Board choosing either help under this chapter or the other employee protection benefits. If an employee picks the other benefits, that choice does not change the order, status, timing, or responsibility for any related claims. An employee cannot get assistance (except moving expenses) while working for a carrier providing temporary service over Rock Island lines, or after receiving a qualified job offer in their craft from a carrier that acquires Rock Island lines.
