You must not sell or give out pesticides or pesticide devices that break the rules. You cannot sell a pesticide that is not registered, or whose registration was canceled or suspended. You cannot sell a registered product with claims that differ from its registration, or that has a different formula than what was registered. You cannot sell products that are tainted, wrongly labeled, missing required coloring, or whose labeling has been removed or changed. You must keep and give required records and reports and allow inspections when asked. You must not lie in applications, reports, or testing data. You must not use a pesticide in ways that go against its label, use it under an experimental permit in the wrong way, or do human testing unless people are fully told the risks and agree freely. You must not reveal confidential information except to the EPA, certain officials, courts, or qualified medical professionals. You must follow any EPA orders about suspensions, cancellations, or other restrictions. The penalties for selling banned pesticides do not apply in five cases: when the seller has a signed written guarantee from the registrant or U.S. source for the same sealed package (the guarantor then takes the penalty), when a carrier is lawfully transporting the product and lets officials copy related records, when a public official acts in their job, when use or possession is allowed by an experimental permit, and when substances are shipped only for testing and not for pest control.
