CVD Investigation Initiated Jan 7, 2025

The Department of Commerce initiated a countervailing duty (CVD) investigation into imports of active anode material from the People's Republic of China, applicable January 7, 2025. The period of investigation is January 1, 2023 through December 31, 2023, and Commerce will make its preliminary CVD determination no later than 65 days after initiation.

Company-Specific Subsidy Rates and Respondent Selection

Commerce intends to calculate company-specific subsidy rates and may select mandatory respondents using U.S. Customs and Border Protection (CBP) entry data. CBP import data for active anode material from China was released under administrative protective order on January 7, 2025, and interested parties wishing to comment on that data or respondent selection must do so within three business days of the publication date of this notice of initiation.

Petition Filed on Behalf of U.S. Domestic Industry

Commerce found that the petition was filed on behalf of the domestic industry because supporting domestic producers account for more than 50 percent of U.S. production of the domestic like product. The petition was filed December 18, 2024, by the American Active Anode Material Producers, an ad hoc trade association of domestic producers.

Precise Product Scope Defined for Coverage

The investigation covers active anode material defined as anode-grade graphite with a minimum graphite purity of 90 percent carbon by weight, energy density of 330 milliamp hours per gram or greater, degree of graphitization of 80 percent or greater, and typically a maximum size of 80 microns in powder form. The scope covers material whether synthetic, natural, blended, coated or uncoated, and regardless of form or whether imported as part of a battery or subassembly.
