Draft SEIS Reviews NO2 and PM2.5
FERC released a draft supplemental environmental impact statement (SEIS) that specifically assesses cumulative air quality impacts from nitrogen dioxide (NO2) and particles 2.5 microns or smaller (PM2.5) for the CP2 LNG and CP Express projects in Louisiana and east Texas. The draft SEIS was prepared after a November 27, 2024 rehearing order directed additional review of these air pollution issues.
Authorization Partially Set Aside for Review
On November 27, 2024, FERC issued a rehearing order that set aside, in part, the June 27, 2024 Authorization Order for the CP2 LNG and CP Express projects to allow additional environmental review related to NO2 and PM2.5. This act means the Commission is re-examining part of its prior authorization for the project.
Intervenor Status Needed to Seek Review
Only parties that have intervenor status may seek rehearing or judicial review of the Commission's decision. To become a party, affected landowners and others must file a motion to intervene under Rule 214 (18 CFR part 385.214) and show good cause for intervenor status.
Comment Deadline for Draft SEIS
Anyone wishing to comment on the draft supplemental EIS must submit comments to FERC by 5:00 p.m. Eastern Time on March 31, 2025. You can file comments electronically via eComment or eFiling on FERC's website or mail a paper copy referencing dockets CP22-21 and CP22-22.

The draft supplemental EIS is available only in electronic format and can be viewed or downloaded from FERC's website and eLibrary. The Commission mailed a Notice of Availability to many stakeholders, but the draft SEIS document itself is online only.
