Landowners Face Possible Eminent Domain
If you are a landowner near the proposed route, the pipeline company may seek an easement to build and operate the facilities but you are not required to agree. If the Commission approves the Pulaski Project and you and the company do not reach an easement agreement, the company could initiate condemnation (eminent domain) proceedings in court and compensation would be determined by a judge under state law.
Construction Will Disturb Hundreds of Acres
Construction of the Pulaski Project would disturb about 657.2 acres of land and Columbia would permanently maintain about 254.0 acres; the rest would be restored. About 27 percent of the pipeline route would parallel existing rights-of-way, and the project includes 41.3 miles of new 30-inch-diameter pipeline and aboveground facilities.
NEPA Review, Possible EIS, and Historic-Property Consultation
FERC will prepare an environmental document (an Environmental Assessment or an Environmental Impact Statement) that will study impacts such as water, wildlife, cultural resources, air quality, noise, socioeconomics, and safety; if an EIS is prepared it will open additional public comment periods. The notice also initiates consultation under Section 106 of the National Historic Preservation Act with State Historic Preservation Offices, tribes, and other parties about effects on historic properties.

You can send comments on the project's environmental scope so they are received by 5:00 p.m. Eastern on January 20, 2025. Comments may be filed using FERC's eComment or eFiling systems or by mail referencing Docket No. CP26-11-000, and the Commission says it will give equal consideration to all comments.
