Who May Sell Alcohol on Reservation
Starting February 26, 2026, no alcoholic beverages may be sold on Siletz Reservation land except at tribally-licensed or tribally-owned businesses operated on Reservation land. That means only businesses holding a tribal license (or owned by the Tribe) may legally sell liquor within the Reservation boundaries.
State Licensing and Applicant Requirements
Tribal liquor licenses will only issue to applicants who provide satisfactory proof of being or becoming licensed by the State of Oregon, show good moral character, financial responsibility, proof of premises (owner or lessee for the license term), pay a license fee, and show that neither applicant nor spouse has a felony conviction. Notice of application must be posted for at least 30 days and published twice before Committee consideration.
Tribal Sales Tax & Quarterly Reporting
The Committee may levy and collect a sales tax on each retail sale of alcoholic beverages on the Reservation (amount set by regulation), include credit card payments, and require taxes to be paid within 30 days after the end of the calendar quarter. Licensees must file quarterly accounting and agree to reviews or audits; audits may be done annually as necessary.
Penalties, Seizure, and License Sanctions
Violations of the ordinance carry civil penalties of up to $500 per violation as damages to defray enforcement costs; contraband alcoholic beverages may be seized and forfeited to the Tribe. Licenses may be suspended or canceled after a hearing with 10 days' notice.
Payment Rules for Liquor Sales
All liquor sales on the Reservation must be cash sales, although the rule allows use of major credit cards. No credit may be extended by sellers, meaning customers cannot buy on credit from sellers but can use major credit cards to pay.
Age Limits, ID Rules, and Under‑21 Prohibitions
The ordinance prohibits persons under 21 from consuming, acquiring, or possessing alcoholic beverages on the Reservation and forbids sales to anyone under 21. Sellers must accept specified IDs (state driver licenses/IDs, military ID, passport, Canadian ID, U.S. territory IDs, or federally recognized Tribal ID).
Short-Term Event Permits Allowed
The Committee may grant a temporary permit for sale of intoxicating beverages for up to three (3) days for tribal or community activities; each permit must follow specified conditions and a fee set by the Committee will apply.
Ordinance Effective Date and Supersession
The amended Siletz Liquor Control Ordinance supersedes the 1997 ordinance and is effective upon Federal Register publication approval, with the amended ordinance effective on February 26, 2026.
