Possible Import Taxes on CBS

The Department of Commerce has opened a countervailing duty investigation into imports of N-Cyclohexylbenzothiazole-2-Sulfenamide (CBS) from the People’s Republic of China, effective May 27, 2026. This investigation could lead to extra import duties (countervailing duties) on CBS imports to address alleged unfair government subsidies and to protect U.S. producers such as LANXESS.

Fast Investigation Timetable

Commerce will make a preliminary countervailing-duty determination no later than 65 days after initiation (initiation date: May 27, 2026). The U.S. International Trade Commission will make its preliminary injury determination within 45 days after the petition was filed (petition filed May 7, 2026); a negative ITC finding will terminate the investigation.

Questionnaires and Company-Specific Rates

Commerce intends to calculate company-specific subsidy rates and will send quantity-and-value (Q&V) questionnaires to each Chinese producer/exporter with complete address information. Responses to the Q&V questionnaire must be submitted by 5:00 p.m. ET on June 10, 2026.
