Notice

Summary

The FAA is extending the rules that limit how many flights can take off and land at Newark Liberty International Airport until October 30, 2027. The extension starts October 25, 2026, helping keep the airport running smoothly without extra costs for passengers.

Analyzed Economic Effects

4 provisions identified: 2 benefits, 2 costs, 0 mixed.

Per-flight civil penalties for exceeding limits

If a carrier operates a flight above the hourly limits at EWR, the FAA may seek civil penalties. A carrier that is not a small business may be liable for up to $75,000 per flight, and a carrier that is a small business may be liable for up to $16,630 per flight.

EWR flight caps extended to 2027

You should know that the FAA is extending limits at Newark Liberty International Airport from October 25, 2026 through October 30, 2027. During this period the airport is limited to 36 arrivals and 36 departures per hour (72 operations per hour) between 6:00 a.m. and 10:59 p.m. Eastern Time to reduce congestion and delays.

New scheduled flights not expected; unscheduled allowed

If you operate or plan to launch scheduled airline service at EWR, the FAA says it does not expect to accommodate new scheduled operations during October 25, 2026 through October 30, 2027. Cargo, charter, and other unscheduled operations will continue to be accepted on a first-come, first-serve basis and foreign carrier returns will be accepted through IATA processes.

Voluntary returns and allocation rules for carriers

If you operate scheduled flights at EWR, you may voluntarily return up to 10% of your operations for the Winter 2026/2027 and Summer 2027 scheduling seasons; returned operations will be treated as operated for establishing an operational baseline for the next corresponding season. The FAA may reallocate these returned operations on a non-historic basis for the duration of the voluntary relief so long as the hourly limit is not exceeded, and carriers will retain historic priority for timings reduced or re-timed under delay reduction proceedings.
